Agreement to Terms
By accessing or using BandJam ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.
BandJam uses YouTube API Services to create and link to YouTube Music playlists for your league rounds. By using BandJam, you also agree to be bound by the YouTube Terms of Service. You can review how Google handles data it receives via the YouTube API in the Google Privacy Policy. You can revoke BandJam's access to the YouTube API Services at any time via the Google security settings page at https://security.google.com/settings/security/permissions.
⚠️ Zero Tolerance Policy
BandJam has a strict zero-tolerance policy for objectionable content and abusive behavior. Any user who posts objectionable content, harasses other users, or engages in abusive behavior will be immediately removed from the platform. We reserve the right to remove content and ban users at our sole discretion.
User-Generated Content
BandJam allows users to create and share user-generated content, including but not limited to:
- Chat messages in leagues
- Comments on submissions
- User display names and profile information
- League names
By using the Service, you agree that:
- You are solely responsible for all content you post
- You will not post objectionable, offensive, or inappropriate content
- You will not harass, threaten, or abuse other users
- You will not impersonate other users or entities
- You will not post spam or unsolicited commercial content
- You will respect the intellectual property rights of others
Content Moderation
BandJam provides tools for users to report objectionable content and block abusive users. We are committed to reviewing reported content within 24 hours and taking appropriate action, which may include:
- Removing objectionable content
- Suspending or permanently banning users who violate these Terms
- Reporting illegal content to appropriate authorities
While we strive to maintain a safe and respectful environment, we cannot guarantee that all objectionable content will be immediately detected or removed. We rely on our community to report violations.
User Accounts
To use BandJam, you must create an account. You agree to:
- Provide accurate and complete information when creating your account
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities that occur under your account
Prohibited Activities
You agree not to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any illegal or unauthorized purpose
- Post content that is defamatory, libelous, or false
- Post content that promotes violence, hatred, or discrimination
- Post content that contains malware, viruses, or harmful code
Intellectual Property
The Service and its original content, features, and functionality are owned by BandJam and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.
By posting content on BandJam, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content within the Service.
Music Content and Copyright
BandJam allows users to submit song names, artist names, and create playlists using third-party music streaming services (e.g., Apple Music, Spotify). By using the Service, you acknowledge and agree to the following:
User Responsibilities
You are solely responsible for ensuring that any content you submit, including song names, artist names, comments, or other user-generated content, does not infringe upon the intellectual property rights of any third party. By submitting content, you represent and warrant that:
- You have all necessary rights, licenses, and permissions to submit the content
- You are not infringing upon any copyright, trademark, patent, trade secret, or other intellectual property right
- You are not violating any applicable laws or regulations
- The content does not contain any material that is defamatory, libelous, or violates the privacy or publicity rights of any third party
- You will comply with all terms and conditions of any third-party music streaming services (e.g., Apple Music, Spotify) that you use in connection with the Service
Copyright Infringement Claims
BandJam respects the intellectual property rights of others and expects users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information in writing:
- A physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
- Your contact information, including address, telephone number, and email address
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
- A statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

Upon receipt of a valid copyright infringement notice, we will promptly investigate and take appropriate action, which may include removing or disabling access to the allegedly infringing content and terminating the accounts of repeat infringers.
Counter-Notification
If you believe that content you submitted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our Copyright Agent with the information required by applicable law. Upon receipt of a valid counter-notification, we will restore the content unless the original complainant files a court action against you.
BandJam's Role
BandJam acts as a platform for users to share information about music and create playlists. We do not host, store, or transmit music files. Music playback is provided through third-party services (Apple Music, Spotify) in accordance with their respective terms of service. BandJam is not responsible for:
- The accuracy, legality, or appropriateness of user-submitted content
- Copyright infringement by users
- The availability, quality, or terms of third-party music streaming services
- Any disputes between users and copyright holders
Indemnification
You agree to defend, indemnify, and hold harmless BandJam, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party right, including without limitation any copyright, trademark, privacy, or other intellectual property right
- Any content you submit, post, or transmit through the Service
- Your violation of any applicable law or regulation
This indemnification obligation will survive the termination of your account and your use of the Service.
Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, for any reason, including but not limited to:
- Violation of these Terms
- Posting objectionable or abusive content
- Harassing or threatening other users
- Engaging in fraudulent or illegal activities
- Requesting account deletion
Upon termination, your right to use the Service will immediately cease, and we may delete your account and all associated content.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
Limitation of Liability
To the fullest extent permitted by applicable law, BandJam, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Service
- Any user-generated content, including but not limited to copyright infringement claims
- Any unauthorized access to or use of our servers or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
- Any disputes between users or between users and third parties, including copyright holders
In no event shall BandJam's total liability to you for all damages exceed the amount you paid to BandJam in the twelve (12) months prior to the action giving rise to liability, or one hundred dollars ($100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BandJam operates, without regard to its conflict of law provisions.
